Commercial Contracts- Global Pharmaceutical Company in New Jersey is seeking an Associate Director/Director to oversee its R&D Contracting Operations Department. There will be substantial interface with other members of the legal department as well as various business units. Responsibilities include negotiating and drafting a wide range of contracts, negotiating with vendors, consultants, and R&D contractors, supervising a staff of contracting personnel, developing policies and procedures for negotiation and preparation of contracts, working collaboratively with clinical development teams in connection with Phase I through Phase IV clinical studies, and managing relationships with Clinical Research Organizations. Candidates must have at least ten years of substantive, hands-on experience in an in house contracting function or at a law firm, at least six years of which is specifically for the pharmaceutical industry supporting a transactional R&D function. Must have prior managerial/supervisory experience and strong management capabilities. Candidates must have a strong working knowledge of contract negotiation and drafting, the FDA Regulatory framework, GCPs, FCPA, fraud and abuse/anti-kickback statutes, health care compliance, privacy (HIPAA) and clinical trial results disclosure issues, IP, and indemnity and liability limitation issues. This position reports to the General Counsel and interfaces with the Global Quality and Regulatory Department. Responsibilities include providing advice and counseling as to legal and regulatory issues pertaining to development and manufacturing of pharmaceutical products, providing FDA advice, serving as the primary contact with the FDA and other regulatory agencies, resolving FDA related issues concerning products and business transactions, counseling on FDA regulations and foreign ministries of health regulations, counseling with respect to laws and regulations pertaining to research, development, approval, safety and manufacturing of pharmaceuticals and medical devices, responding to regulatory agency enforcement actions, conducting and overseeing internal regulatory-related investigations, participating in company training initiatives on regulatory matters, providing guidance in the review of promotional and marketing materials, assisting in regulatory aspects of merger & acquisition activity and managing outside counsel. Candidates should have a minimum of 8-12 years of FDA regulatory experience working in a large law firm, government agency or corporate law department. Must have a thorough knowledge and understanding of the Food, Drug & Cosmetic Act, equivalent foreign statutes and associated regulations and guidelines, particularly with regard to the regulation of pharmaceutical manufacturing and cGMP. Must have in depth knowledge of the pharmaceutical and biotech industry as well as associated regulatory agencies around the world including the MHRA and the EMEA.
